TRUCK PARKING

AN ORDINANCE TO REGULATE THE PARKING OF TRUCKS WITHIN THE VILLAGE OF DEERFIELD.

THE VILLAGE OF DEERFIELD ORDAINS:

Section 1. DEFINITIONS

The meaning of terms used in this Ordinance shall be as follows:

• a. "Truck" shall mean a "truck,” "truck tractor,” "trailer,” "semi-trailer,” or any combination thereof, as defined in Act 300 of the Public Acts of Michigan of 1949, as amended.
• b. "Truck" is further defined as any common carrier, tractor trailer, tow-truck, or dump-truck, delivery truck and any other truck larger than a van, panel, or pick-up truck, which is used or employed by its operator or owner as a vehicle by which goods, raw materials, products, commodities, or other commercial items are transported.

Section 2. TRUCK PARKING GENERALLY PROHIBITED

Except as hereafter provided no person, individual, firm, partnership, or corporation shall park a truck on public or private property located within the Village limits and in no event, may any truck be parked overnight on the streets within the Village.

Section 3. PERMITTED TRUCK PARKING

A truck may be parked upon private property which is zoned commercial or industrial, pursuant to the Zoning Ordinance of the Village of Deerfield, so long as access to said property is entirely on a designated truck route and so long as the truck does not physically or visually block or interfere with entry to or exit from public or private streets, roadways, alleys, and driveways.

Section 4. EMERGENCY VEHICLES AND CASUAL PARKING

No provision of this Ordinance shall restrict the emergency use of nor the casual or incidental commercial pickup or delivery to any individual, residence or business upon the streets within the corporate limits of the Village of Deerfield.

Section 5. POSTING OF SIGNS

Signs shall be posted on the streets of the Village of Deerfield giving notice of the prohibition against truck parking.

Section 6. PENALTIES

Every person who is convicted of a violation of this Ordinance shall be punished by a fine not to exceed one hundred dollars ($100) or imprisonment in the discretion of the Court.

Section 7. SEVERABILITY

Should any section, clause or provision of this Ordinance be declared by a court to be invalid, the same shall not affect the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.

Section 8. CONFLICTING ORDINANCES REPEALED

All ordinances or parts of ordinances in conflict with any provisions of this Ordinance are hereby repealed.

Section 9. PUBLICATION OF ORDINANCE

The Village Clerk shall publish this Ordinance in the manner prescribed by law.

Section 10. EFFECTIVE DATE

This Ordinance shall take effect thirty (30) days after adoption and publication.
