Village of Deerfield Ordinance 15

THE VILLAGE OF DEERFIELD ORDAINS:

Section 1. CREATION OF PLANNING COMMISSION

Pursuant to Act No. 285 of the Public Acts of 1931, the Village of Deerfield, County of Lenawee, Michigan hereby creates a Planning Commission with the powers and duties as defined in the Act. The Commission shall hereafter be designated the Village of Deerfield Planning Commission.

Secion 2. MEMBERSHIP

The Planning Commission may consist of nine members, one of whom shall be a member of the Village Council to be selected by resolution of the Council to serve as a member ex officio, and eight of whom shall be appointed by the Village President. The eight members appointed by the Village President shall be selected to represent, as far as is possible, different professions or occupation. An appointment by the Village President shall be subject to approval of the Council by majority vote.

Section 3. COMPENSATION FOR MEMBERS

All appointed members of the Planning Commission may be compensated at a rate to be determined by the Village Council.

Section 4. HOLDING OTHER OFFICES

An appointed member of the Planning Commission shall not hold another municipal office except that one of the appointed members may be a member of the Village Zoning Board of Appeals.

Section 5. TERM OF OFFICE

a. The term of the ex officio member of the Planning Commission shall be determined by the Council and shall be stated in the resolution selecting the ex officio member, but the term shall not exceed the member's term of office as a Council member.
b. The term of each appointed member shall be three years commencing April 1st of the year appointed or until his or her successor takes office, except that the respective terms of two of members of the first Planning Commission appointed following adoption of this Ordinance shall serve for one year and three of the members first appointed shall serve for two years.

Section 6. REMOVAL OF MEMBERS

a. After public hearing, the Village President may remove a member, other than the member selected by the Council, for inefficiency, neglect of duty, or malfeasance in office.
b. The Village Council may for like cause remove the member selected to serve on the Planning Commission by the Council.

Section 7. VACANCIES

A vacancy on the Planning Commission occurring otherwise than through the expiration of a term shall be filled for the unexpired term by the Village President, in the case of a member appointed by the Village President and by the Village Council, in the case of the member appointed by the Village Council.

Section 8. ORGANIZATION

a. The Planning Commission shall elect its chairperson from among the appointed members and create and fill such other of its offices as it may determine.
b. The term of the chairperson shall be one year, with eligibility for reelection.
c. The Planning Commission shall hold at least one regular meeting in each month.
d. The Planning Commission shall adopt rules for transaction of business and shall keep a record of its resolutions, transactions, findings and determination which record shall be a public record.

Section 9. POWERS AND AUTHORITY

The Planning Commission shall be vested with all of the powers and authority granted to it in Act No. 285 of the Public Acts of 1931.

Section 10. VOTING RIGHTS OF EX OFFICIO MEMBER

The ex officio member of the Village Planning Commission shall have full voting rights.

Section 11. EFFECTIVE DATE

This Ordinance shall become effective thirty days after its adoption.

Section 12. PUBLICATION OF ORDINANCE

The Village Clerk shall publish this Ordinance in the manner prescribed by law.
