PLANNING COMMISSION


AN ORDINANCE TO CREATE A VILLAGE PLANNING COMMISSION AND TO SPECIFY THE MANNER IN WHICH MEMBERS OF THE PLANNING COMMISSION SHALL BE APPOINTED


THE VILLAGE OF DEERFIELD ORDAINS:

Section 1. CREATION OF PLANNING COMMISSION

Pursuant to Act No. 285 of the Public Acts of 1931, the Village of Deerfield, County of Lenawee, Michigan hereby creates a Planning Commission with the powers and duties as defined in the Act. The Commission shall hereafter be designated the Village of Deerfield Planning Commission.

Secion 2. MEMBERSHIP

The Planning Commission may consist of nine members, one of whom shall be a member of the Village Council to be selected by resolution of the Council to serve as a member ex officio, and eight of whom shall be appointed by the Village President. The eight members appointed by the Village President shall be selected to represent, as far as is possible, different professions or occupation. An appointment by the Village President shall be subject to approval of the Council by majority vote.

Section 3. COMPENSATION FOR MEMBERS

All appointed members of the Planning Commission may be compensated at a rate to be determined by the Village Council.

Section 4. HOLDING OTHER OFFICES

An appointed member of the Planning Commission shall not hold another municipal office except that one of the appointed members may be a member of the Village Zoning Board of Appeals.

Section 7. VACANCIES

A vacancy on the Planning Commission occurring otherwise than through the expiration of a term shall be filled for the unexpired term by the Village President, in the case of a member appointed by the Village President and by the Village Council, in the case of the member appointed by the Village Council.

Section 9. POWERS AND AUTHORITY

The Planning Commission shall be vested with all of the powers and authority granted to it in Act No. 285 of the Public Acts of 1931.

Section 10. VOTING RIGHTS OF EX OFFICIO MEMBER

The ex officio member of the Village Planning Commission shall have full voting rights.

Section 11. EFFECTIVE DATE

This Ordinance shall become effective thirty days after its adoption.

Section 12. PUBLICATION OF ORDINANCE

The Village Clerk shall publish this Ordinance in the manner prescribed by law.
