Village of Deerfield Ordinance 12

THE VILLAGE OF DEERFIELD ORDAINS:

Section 1. OWNER OF DOG DEFINED

Any person who keeps or harbors any dog or has it in his care or who permits any dog to remain about any premises owned or occupied by him shall be deemed the owner of such dog for purposes of this Ordinance.

Section 2. LIMITATION OF NUMBER OF DOGS ALLOWED

It shall be unlawful for any person to own, possess, shelter, keep or harbor more than three dogs over six months of age at any one time in one residential building or garage or any residential, business or other lot in the Village of Deerfield. This provision shall not apply to dogs being kept by a veterinarian or in a veterinarian hospital, a commercial pet shop or a licensed kennel.

Section 3. LEASH REQUIRED

It shall be unlawful for the owner of any dog to allow such dog to go beyond the premises of the owner unless the dog is held securely on a leash not more than eight (8) feet in length and held at all times by some person over the age of seven (7) years.

Section 4. LOUD AND BARKING DOGS

It shall be unlawful for any person to own a dog which by loud and frequent barking, howling, yelping, growling or any other noise, causes annoyance to the people of the neighborhood.

Section 5. VICIOUS DOGS

It shall be unlawful for any person to own a fierce or vicious dog. Any dog shall be deemed vicious once it has bitten a person or domestic animal without molestation or which by its actions gives indication that it is liable to bite any person or domestic animal with molestation.

Section 6. PENALTIES

Any person violating any provision of this Ordinance shall be guilty of a misdemeanor punishable by a fine not exceeding one hundred ($100.00) dollars and costs of a prosecution or by imprisonment not exceeding ninety (90) days or by both such fine and imprisonment.

Section 7. EFFECTIVE DATE

This Ordinance shall take effect 20 days after its passage.
